If the driver of the car that hit you is drinking, you still have a personal injury claim. You may also have some additional claims if that person is found and convicted to be driving under the influence. Such claims are normally called punitive damages, where you would be able to recover damages beyond a normal personal injury claim. If you believe that the driver that caused your accident was drinking, you need to speak to a competent council as soon as possible.
