If the insurance company for the at-fault driver offers you a check right away, beware. You should not accept that check. Usually, that means the insurance company is trying to buy you off to get a release against their insured before you even know the value of your claim. You need to fully understand what your damages are; your unpaid medical bills, your lost wages, your entitlement to future care, and your pain and suffering. If an insurance company offers you a check, don’t accept it. Speak to competent counsel so that you can fully understand your rights.
